
ADA Title III lawsuits are increasing. A mid-year 2026 federal ADA Title III lawsuit filings reached 5,006, the highest first-half total since 2021 and a sign that the year could end above 10,000 cases.
California remained the top state for filings with 2,426 cases, followed by Florida, Illinois, and New York, while newer plaintiffs’ firms appear to be driving growth in several states.
HUD rescinded prior guidance on emotional support animals in housing and will now focus reasonable cause findings on service animals, but housing providers still must consider state and local laws and should review ESA requests case by case.
The DOJ extended website accessibility deadlines for state and local governments under Title II by one year, but litigation risk remains and covered entities should keep working toward WCAG 2. 1 AA compliance.
Recent court and agency actions show mixed signals for accessibility litigation, including a New York case dismissing claims as moot after accessibility improvements, a DOJ challenge to a website accessibility settlement, and NFB’s lawsuit against deadline extensions.
