
The Department of Justice filed a Statement of Interest opposing a class action settlement involving the accessibility of the Fashion Nova website. It is between Fashion Nova Inc. and the plaintiffs over an inaccessible website design for users with vision disabilities.
The proposed settlement includes a $2.43 million payout to eligible class members and over $2.52 million in attorneys’ fees, with vague promises for making the website accessible.
The DOJ criticized the settlement for offering little real value to consumers with disabilities and for lacking concrete enforcement mechanisms to ensure accessibility.
Assistant Attorney General Harmeet Dhillon emphasized that ADA class actions should prioritize accessibility improvements over attorney compensation.
The U.S. District Court for the Northern District of California must approve the settlement, and under the Class Action Fairness Act, the DOJ can review and comment on such agreements.
