One hundred congressional Democrats are urging the DOJ to rescind a June 18 opinion they say weakens disability-rights protections and the integration mandate under the ADA and Rehabilitation Act.
The DOJ recently said the Olmstead integration guidance is not enforceable and will be revisited, with the agency no longer relying on it when enforcing Title II of the ADA.
Lawmakers and disability advocates warn the change could reduce home- and community-based services, push funding back toward institutions, and increase confusion for states and providers.
Critics argue the move could lead to more unnecessary institutionalization and undermine the preference of many people with disabilities to receive care in community settings, including assisted living.
